Official Rules for Bumkins Baby Photo Contest
PLEASE READ CAREFULLY.
These official rules govern your participation in the Bumkins Baby Photo Contest (the “Contest”). By participating in the Contest, you agree to be bound by these official rules and represent that you meet the eligibility requirements set forth below. The sponsor of the Contest is Bumkins Finer Baby Products 7802 E. Gray Rd. #500 Scottsdale, AZ 85260 (“Sponsor”).
Eligibility: Participation in the Contest is restricted as follows: to be eligible a parent or legal guardian must approve submission of the contestant’s photo(s). Directors, officers, employees and agents of Bumkins, its subsidiaries, sales representatives, advertising and promotion agencies, and the immediate families of each (collectively, the “Contest Entities”), are not eligible to participate. Participation in the Contest is at your discretion. No purchase or payment of any money is necessary to participate or win an award. Void where prohibited or restricted by law.
How to participate: Submit the photos and application information via web site. Bumkins will be accepting applications and photos from July 25, 2008 through September 1, 2008 (12:00am MST). Bumkins reserves the right to refuse all entries submitted after this time.
Prize: Prizes are based on availability and are subject to change. In the event of a change, a prize of equal or greater value will be substituted. All prizes will be modified to suit the winner’s gender and age (each a “Prize”).
Winner selection and Notification: The Contest is judged by employees of Bumkins and such selection is solely within Bumkins discretion. All decisions of Bumkins are final and not appealable. Distasteful photos, as determined solely by Bumkins, including photos with nudity or depicting children in a derogatory or dangerous poses will not be accepted. Bumkins reserves all rights to refuse any photo(s). The Prize is not transferable or redeemable for cash. The winners are responsible for any applicable federal, state or local taxes associated with the receipt of the Prize.
Winners will be announced within 30 days after winning photo has been selected. Winners will be informed via email at the address provided by contestant and parent or legal guardian, and prizes will be released within 2 weeks of announcement. Bumkins shall not be liable for typographical or other errors made by contestant, parent or legal guardian.
General Conditions: By participating in the Contest, except where prohibited by law, you hereby grant Sponsor the right to use your name, photograph, business affiliation, statements and likeness, in all media for publicity purposes throughout the world without additional compensation. By submitting a photo, contestant and parent or legal guardian grants Bumkins the right to use such photo(s), child’s first name and city, on the Bumkins’ website or other marketing materials. Slight photo alterations may be made by Bumkins in order to fit website or other marketing materials properly. The contestants shall be responsible for knowing whether they reside in a state that prohibits photo contests and are subject to any local, state or national laws. Bumkins accepts no responsibility for making these individual legal determinations. All decisions of Sponsor are final and binding on all participants. The Prize is awarded “AS IS” AND WITHOUT WARRANTY OF ANY KIND, express or implied, including without limitation, any implied warranty of merchantability or fitness for a particular purpose. THE WINNERS RELEASE ALL SWEEPSTAKES ENTITIES FROM ANY LIABILITY WHATSOEVER FOR, AND WILL INDEMNIFY AND HOLD ALL SWEEPSTAKES ENTITIES HARMLESS FROM, ANY CLAIMS, COSTS, INJURIES, LOSSES OR DAMAGES OF ANY KIND RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF OR INABILITY TO USE THE PRIZE OR FROM PARTICIPATION IN THE SWEEPSTAKES. Sponsor reserves the right to change these official rules at any time or to suspend or cancel the Contest or any person’s participation in the Contest should anything affect the administration, security or proper play of the Contest. Persons who violate these official rules, tamper with the operation of the Contest or engage in any conduct that is detrimental or unfair to the Sponsor or any other person (as determined in the Sponsor’s sole discretion) are subject to disqualification. The Contest is subject to all applicable federal, state and local laws and regulations.
Intellectual Property: By submitting a photo(s), contestant and parent or legal guardian warrant and represent that such photo(s) does not infringe the intellectual property rights of any other entity. Contestant and parent or legal guardian will hold Bumkins harmless from claims of intellectual property infringement and will indemnify Bumkins for any such claims. In the event a photo(s) taken by someone other than contestant or contestant’s parent or legal guardian is submitted, Bumkins recommends that the parent or guardian obtain written permission from such photographer to use the photo(s) prior to contest submission.
By submitting the form above with photo, you agree that you are the legal parent or guardian of the contestant; and you hereby acknowledge that you have read the Official Rules and agree to be bound by the terms and conditions of this Contest. |
